Working together
Clear terms.
Better work.
These terms cover the M+ Labs website, client portal, and services provided by M+ Labs (Pty) Ltd.
Last updated 31 October 20261. About these terms
This website and the M+ Labs services are operated by M+ Labs (Pty) Ltd in South Africa. “We”, “us”, and “M+ Labs” refer to that business. “You” means a person or organisation using this website, contacting us, or purchasing a service.
By using the website or client portal, you agree to follow these terms. A project proposal, statement of work, subscription description, or other written agreement may add specific terms for a particular service. If it conflicts with these general terms, the specific written agreement governs that service to the extent of the conflict.
2. Services and project scope
M+ Labs provides digital services such as website and software development, eCommerce, hosting, automation, consultation, and related support. A discussion or enquiry is not an agreement to start work. Before custom project work begins, the scope, deliverables, fees, timing, payment milestones, and any ongoing support should be set out in a proposal or other written agreement accepted by both sides.
We may update service descriptions on this website. A website description is general information and does not replace the agreed specifications or product details presented for a purchase.
3. Your responsibilities
You agree to provide accurate information, approvals, materials, and access reasonably needed for the agreed work, and to ensure that you have permission to use materials you give us. Delays in receiving required materials or decisions may affect delivery dates or costs; we will discuss material changes with you.
You must not use the website, portal, or services to break the law, infringe another person’s rights, distribute malicious code, interfere with security, or attempt to access another client’s information.
4. Accounts and client portal
Portal access is provided to invited client accounts. Keep your sign-in credentials confidential, use a strong unique password, and tell us promptly if you suspect your account has been accessed without permission. You are responsible for activity performed through your account unless it resulted from our failure to use reasonable security measures or applicable law provides otherwise.
We may suspend or restrict access where reasonably necessary to protect an account, the portal, another client, or the security of our services. We will restore access when the reason for the restriction is resolved, where appropriate.
5. Content and ownership
You retain rights to materials you provide to us. You give us permission to use those materials only as needed to deliver the agreed services. Ownership or licensing of deliverables, source code, designs, and third-party components will be stated in the relevant proposal or service agreement. Third-party tools and open-source components remain subject to their own licences.
Unless a written agreement says otherwise, you must not copy or commercially exploit M+ Labs branding, website content, or reusable tools and materials. We will not publish client work or identify you as a client without your permission, except where the law requires it.
6. Fees, payments, and Paddle
Prices, billing intervals, taxes, and renewal terms for a purchase are shown at checkout or in the applicable written agreement. You are responsible for reviewing those details before confirming an order. Any recurring subscription will be identified as recurring before you complete checkout.
For a Paddle order, use the transaction receipt or Paddle buyer support for payment questions, cancellations, and refund requests. For a custom project, follow the payment milestones and cancellation terms in your accepted proposal or agreement.
7. Availability and third-party services
We work to keep the website and portal available, but maintenance, updates, service-provider interruptions, or events outside our reasonable control may temporarily affect access. We may change or discontinue a website feature; this does not change an active written project agreement without agreement or a legal basis.
Some services may depend on third-party hosting, payment, software, or communications providers. Their terms and privacy notices apply to the parts of their services they operate. We are not responsible for a third party’s independent service or policy, except to the extent applicable law makes us responsible.
8. Privacy
Our Privacy Policy explains how we handle personal information. By using the portal, you acknowledge that information needed to operate your account and provide services will be handled as described there.
9. Warranties and liability
We will provide agreed services with reasonable care and skill. Except for commitments in a written agreement and rights that cannot lawfully be excluded, the website and general information are provided without a promise that they will always be uninterrupted, error-free, or suitable for every purpose.
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability that cannot be excluded under mandatory consumer-protection law. Subject to that, neither party is liable to the other for indirect or unforeseeable loss arising from use of the website. Any liability limit for a paid service will be stated in the applicable written agreement and will apply only as far as the law allows.
10. Changes and ending a service
We may update these general terms by publishing a revised version on this page. The version in force when you use the website applies to that use; a signed project agreement or completed purchase remains subject to the terms applicable to that agreement or transaction, along with mandatory law.
Either party may end a custom service as set out in the relevant written agreement. Subscription cancellation and Paddle transaction refunds are handled under the checkout terms and the Refund Policy.
11. Governing law and contact
These general terms are governed by the laws of South Africa, subject to any mandatory consumer-protection rules that apply to you. Disputes relating to a Paddle transaction may also be subject to Paddle’s Buyer Terms.
